Flash problem... can you help me? Can't Post

My Nikon D70s has this little issue.. the little flash on it wont stay shut... ?? any one else have this problem??? and happen to know what I am doing wrong???

It wont lock down at all... it doesnt look like the little bracket is broke.. you can feel and hear it clicking into place.. it just let's go when I take my hand off it... it's as if I am going to have to tape it down...

It did this once before ... and it finally just stayed... but I am thinking it's a setting or something that is keeping it from locking back down into place??? Is it a D70 thing>> or am I missing something stupid... ( BTW I am very good at "duh" moments!) thanks soooo much for any info!
