It really depends on how intrusive you plan to be, or not to be. I have picked up footage in countless public places, but was wearing regular clothes (not something identifying me as a professional video producer), and using, mostly, a Canon GL2 for acquisition, occasionally a wireless mic setup. I have picked up footage on beaches, in parks, at museums and tourist destination points (even Disneyland) in this manner. By the same token, I once was shooting footage of a parade event (How much more public can you get?), but probably because I was operating with a small crew for sound & reflectors/lights, a motocycle cop stopped and inquired if I had a city permit for this operation. We were asked to pack up our equipment and stop shooting. We waited until the officer moved on down the parade line, then went back to our business with no further interruptions. Also, regarding the wearing of identifying apparel - since we've done stringer work for various cable channels (usually channel 3) up and down the California coast, I have a cap and shirts that read "TV-3" productions. Whether I am actually working on behalf of SBTV-3, HBTV-3, or some other cable channel, or independently, the assumption that I am officially there, sanctioned by the local access/public access people or cable station, often has gotten me into places from where I'd would otherwise be sent packing, or flat denied access or cooperation. Mostly, being unobtrusive and working single or with smaller gear will get you what you need without the hassle and expense of seeking and paying for permits, or even going through the process only to be denied, then trying to sneak in and shoot anyway guerrilla style.
