It really depends on how intrusive you plan to be, or not to be. I have picked up footage in countless public places, but was wearing regular clothes (not something identifying me as a professional video producer), and using, mostly, a Canon GL2 for acquisition, occasionally a wireless mic setup.

I have picked up footage on beaches, in parks, at museums and tourist destination points (even Disneyland) in this manner.

By the same token, I once was shooting footage of a parade event (How much more public can you get?), but probably because I was operating with a small crew for sound & reflectors/lights, a motocycle cop stopped and inquired if I had a city permit for this operation. We were asked to pack up our equipment and stop shooting. We waited until the officer moved on down the parade line, then went back to our business with no further interruptions.

Also, regarding the wearing of identifying apparel - since we've done stringer work for various cable channels (usually channel 3) up and down the California coast, I have a cap and shirts that read "TV-3" productions. Whether I am actually working on behalf of SBTV-3, HBTV-3, or some other cable channel, or independently, the assumption that I am officially there, sanctioned by the local access/public access people or cable station, often has gotten me into places from where I'd would otherwise be sent packing, or flat denied access or cooperation.

Mostly, being unobtrusive and working single or with smaller gear will get you what you need without the hassle and expense of seeking and paying for permits, or even going through the process only to be denied, then trying to sneak in and shoot anyway guerrilla style.

there are some (most) places that will have no problem with you filming there, but others (wal*mart, some malls) that will not allow you in under any circumstances. you should find out who owns the area and talk to them, if you think there is a risk of getting kicked out.

Malls are private property and if security sees you filming they will likely ask you to leave or at least ask you for your license to shoot there... and then ask you to leave.
Especially if you have tripods and pro or prosumer cams.

If you have a dinky little handycam, you might be able to skate without them noticing, but they will probably kick you out if they do notice. Most parks and even streetside/storefronts I think are OK. Of course, I'm not a lawyer so if you get cited, don't blame me!

Cheers!
what's the project?

You need a permit, generally from the state film commission, to shoot in a public place, like a park.

You need the owner's permission to shoot on private property, such as a store, mall, or parking lot.

In either case, you will need to show proof of insurance. Short term coverage for film projects is available.

Haven't you ever seen Cops - New Orleans (with video crews out making explicit documentaries), or more recently any national news about illegal immigrants finding work with contractors (that obviously are paying for cheap laber and operating without proper ; even when I was watching Flip This House on A&E the other night, a big part of the episode was that the construction crew operated without proper government permits.

Legally, you're obligated; but, realisitically, most people probably don't go and get permits. It just takes too long, and the government works sooo slow. Of course, if you are a big time producer, and lotz of money is involved with unions and so forth, you want all your ducks in a row.

Insurance: A quick search turned up several possibilites, such as this one: http://www.aeinsurance.com/packages.htm (I don't endorse this firm, I'm just giving it as an example to show it isn't that hard to find.) I suggest you start with your own insurance agent (or your dad's); he will be able to give you several leads.

Permits: That depends on where you are. I happen to be in Virginia, so I found the following with a web search on "virginia film permits": http://www.film.virginia.org/...cations/Business.htm
