Freelance License Can't Post

Hal,
In order to work as a freelancer can you simply obtain a VIN number for tax purposes without have to become a sole proprietor, corporation, etc? About 5 years ago I was able to find a book pertaining to the legalities of just being a freelancer but can't seem to find anything more recent.

Pam,
You should check with the government offices in your
county seat. Ask if you need a license to run a business.
If so, it would not be a VIN (Vehicle Identification Number).
You might need a sales tax authorization if you need to collect
and pay sales tax. This is an application you make to your
state rather than to the local gov't.
Fortunately most freelancers do not need any of the above.
I would ask friends who are in business for the name of a
good accountant for a small business and take it from there.

You don't want a VIN number, it's a EIN number that is your
tax ID number. I belive that you're assigned this number
throught your state's business licensing borad. You get it with
your State/County/City business license. You should have this
license if you don't already have one. It's required if you want
to do business under an assumed name, like "Pro Video Experts"
or something like that. You can't get a business checking
account with a bank without one!

You can't get a business checking account with just a tax ID number either, as I have recently found out. You have to have a DBA (Doing Business As) as well. But, depending on what state you live in, you may have to have your tax ID number too. No matter how many times I go around with the state comptrollers office the say I am offering a product rather than a service so I have to charge sales tax. SUCK!

Pam --
There are three levels to it: federal, state, and local.
For the feds -- if you want to set up an unincorporated business so that you can have separate books, bank account, etc., all you need is a "TIN" (or EIN) -- a taxpayer ID number.
This is FREE for the asking.
Then, when you file taxes each year, you report your business income (for the Feds) on a Schedule C, which is a pretty easy form to deal with.
The Feds don't really care what you do for a living, just as long as you pay taxes.
The next level is STATE. This depends on what state you live in. Here in New York, with a federal tax ID number, you can set up a special bank account for your business.
If you run your business under a different name than your own, you need to register the business name with the county you're doing business in.
There is a fee for this that keeps going up but it's still quite modest. You register with the county clerk and get a certificate. You then use that, with your federal tax ID number, to start your bank account.
Again, they don't care what you do, as long as your papers are filed.
Finally, there's local. I'm not aware of any licensing done here in New York for freelance videographers... but any little town or village can come up with some screwy rules. Ask someone else in the business (locally) before you get involved with the bureaucrats. (You'll get a straighter answer.)
But, for the most part, if you're paying your taxes and not stepping on anyone's toes, the powers to be won't step on yours.
