HI, I'm new here, and I need some help. Can't Post

I will be taking on a "special interest video" project for a chiropracter in my area. I've done close to 125 weddings, shot a demo for a local band and even made a short horror film, but I have never attempted anything like this. Any imput would be really helpful to me . If I'm sweating this for no reason please say so. Thanks a million.

P.S It's just a matter of time before WAL-MART puts the squeeze on us to.

Don't sweat the production. But DO sweat the contract! Be sure that both of you are clear on who has what rights.

For example, are you just doing the job, getting paid, and then getting out, leaving all sales of the video to the client? That's easy and simple. But if you have a deal to share in the sales, you both need to understand who does what (duplication, marketing, etc), who gets paid for what, how much, and for how long.

Hey thanks for the reply, here's the deal around $500 for the shoot/editing and $5 a DVD copy. These DVD's will be given out to clients w/questions or concerns about chiropractic procedures. The Dr. I'm working for is someone I've known for years but if it was'nt how do you contract the gig to avoid any duplication problems?

OK, if you are to be the exclusive provider of DVDs, then your contract should state that you retain the copyright to the finished work, that you will retain the edit, archival, and duplication masters, and that the client agrees to use you to provide distribution copies at X per copy. You should specify the format (DVD-R, e.g.), and whether color labels and/or jackets or cases will be provided.

The contract should specify what will happen in case of defective discs (e.g., replacement copy, copy on VHS tape, etc.)

If you want, you could include things like minimum orders, quantity discounts, etc, but that's just icing.
