Instructional Video - Need agreement template Can't Post

A local guitarist wants to do an instructional video. I am considering doing it pretty much "on spec" with very little money up front because I have no track record with this sort of thing and I can use the finished product as a demo, and because he's a friend. But I still want to be businesslike about it. What percentage of any profits would be fair to ask for? Where can I find an ageement template to use? I know there are considerations which I would never even think of without using such an agreement. Thanks.

I would suggest a couple things:

Require *some kind of payment from him. Without any payment, he may not take it seriously and not give you the time you will need with him to do a good job.

This amount could include X number of copies. He agrees to buy further copies from you only. If you just make a royalty deal and he's never doen that before, you may never see another cent. This way at least, you make it easy for him to get more copies at a very reasonabale price and make paymetns to you as the DV sells.

I don't have a contract to offer you on this one, but I think you may find my new book helpful.

If you're doing this on percentage of profits, you put all the work in and then leave it in his hands to do the work to get you your money. Not really a good idea unless you think this is the next big thing.

People respect more when they pay for things, if it is free they most often think it is not worth anything. If they pay money upfront they are apt to get any corrections to you in a timely manner and take it seriously.

That's my advice anyway.
As for a contract, see if you can get some from other sites or if this is something you want to do in the future you could get a paralegal to help you draw up a contract.

Not sure if this is the advice your looking for, but I'd suggest that since this is your first time doing this that you simply agree to split income and expenses evenly. I think you will be surprised at how difficult it will be to set up your distribution channels for the finished video. Once you finish the video, who will want to buy it? How will you reach them? Do you have a marketing plan for introducing the video to prospects? These are one of many questions that you'll need to answer in order for this project to be successful.

You can create a contract if you like, but I would focus more on taking detailed notes regarding how the process works this time around so you will know exactly what to consider in the future. All your findings can be incorporated into future production contracts with your friends or anyone else. If you want to have something documented so that you and your friend will remain friends, I'd type up something that states you and he will create this project together, what each person's responsibilities are, and that you will share all expenses and profits realized in the project. Then both of you sign, keep a copy and hopefully never have to pull it out.

One of the best ways to learn how to do something properly is to try it first or consult with someone that has experience in whatever you are trying to do. Then, as you have your successes and failures, make notes and correct for the next go around. Now, if you were doing this with anyone other than your friend, I would tell you to get a lawyer involved so that you can have an agreement drawn up that protects you and your partner in the project.

I'm just not sure this deal requires all that hassle.

dude, charge him for your time in production and post. and don't get to involve in sharing any revenue from the sale of the DVD. In case he doesn't use his own tunes and plays copyrighted songs on the DVD, then you won't go down with him when BMI/ASCAP etc come knocking at his door.

Cash in Hand is for sure. Mail box money comes with strings attached.
