Well, the story is getting more interesting.

For those new to this story, here are the broad strokes ---

Last Fall, I started working as a sub contractor for a Video Production Company a couple of hours from me, who promised to pay me for travel, mileage, four hour minimum, etc. etc. etc. if I covered some depositions for him; since he "has a lot of trouble finding qualified videographers."

I worked a lot very quickly and sent him invoices.

Too much time went by without getting paid, so I began to inquire why. He was a real jerk about it, and I realized I may be dealing with a welcher. He owed me about $4,000.

Finally I got paid for an invoice and I noticed he had crossed out line items and paid me what he felt like paying me.

He was real bitchy when I contacted him and I demanded to be paid for the work I did.
More invoices were paid --- incorrectly.

Then he really screwed up. I shot an all day deposition, and he insisted that "it was less than one hour."

Here are the updates:

I was so furious, I called the court reporting firm that hired him and asked them how long the deposition was, and to let Mr. X know, so he can pay me the correct amount.

I then printed out some old e-mails Mr. X sent me, where he mentioned he will pay me a four hour minimum, etc. I faxed them to Mr. X.

He did not seem to care so I hired an attorney.

One of the court reporters offered to help settle the matter, but Mr. X has made no effort to do so.

Today I communicated with my attorney. Mr. X's attorney wrote a letter with the following points:

MR. X is willing to provide remuneration but will NOT pay me for transportation costs.

The attorney then claims that MR. X has a viable cause of action against me for defemation and tortious interference, and that if Mr. X pays me what he owes me, that I will have to sign a letter of retraction, sign a nondisparagement agreement, blah, blah, blah.

FYI I have 5 lawyers in my family. Over the years we have all laughed about people making stupid, empty threats like "LIBEL!" "SLANDER!' "DEFAMATION!" "TORTIOUS INTERFERENCE!" Basically those are threats that idiots use who know nothing about how our legal system works. Point blank ---- people go to court to win, not lose. It is nearly imposible to win such cases. And even if you win, what do you win? You can not squeeze water out of a rock!

What's he going to do, sue me for calling a court reporter and asking how long a deposition was? He's going to spend money going to court for that? And if he wins, what does he really think he'll ge to get out of me? Gimme a break.

As for defamtation ---- he would have to prove I LIED about him and ruined his standing in the community TRUTH IS THE BEST DEFENSE.

As for "tortious interference" he would have to prove that I purposely went out of my way to destroy his business and that court reporters will not work with him anymore because I called about the length of a deposition.

It's all so silly.

I hate when lawyers think everyone is so stupid that we will fall for such silly threats.

As far as I am concerned, that guy owes me money and he needs to pay me, and I have no reason to sign any thing, any time, just to get paid.

"Defamation" ???????? Give me a break.

The other day I went out to eat and the waitress gave me back too much change ($6.00 and some coins). I told her she gave me too much and she denied it. My friend was motioning to me to let it go, but I didn't. I knew I was right. It was a small place. Every dollar counts. They have only a few employees. Maybe she would lose her job over this. Or at the very least, she may have had to put the money in the register at the end of the night to balance the books. Maybe she could not afford it. She still would not believe me . So I put it in her tip jar and told her, "Well if I am right, here's the money for the register. If I'm wrong. Keep it." And I left.

Then the world has insects like Mr. X who won't pay me for what I was hired to do. And then he hires an attorney to make empty threats --- claiming that tring to get proof of what I am owed is considered "defamation" and "tortious intereference." Give me a break.

Ivan Tors was right. Dolphins are smarter than humans.

Your problems pale into insignificance to the pain and suffering that them poor souls suffered! Why even mention them in the same breath as a wrangle over money with some poxy client of yours!?

Good luck with all further negotiations and I hope you find a resolution that enables you to move on.

I watched a movie the other day called THE GREY ZONE. It was one of the most upsetting films I ever saw in my life. It was about Jews who are forced to work in the crematoria of Auschwitz. Nazis were killing people in ways that can't be described ---- and I thought, "what have we learned in 60 years?" People are still sick and miserable to one another.

My point was that the world has not changed. People have not changed. Maybe I am too idealistic, and I try to hard, but wouldn't it be nice if people went out of their way to be GOOD instead of BAD? Wouldn't it be nice if people went out of their way to do things the RIGHT way, instead of trying to screw people out of nickels and dimes?

I guess I just don't understand how some people sleep at night. No matter what the extent of what someone does wrong in a day or in their life --- how do some people sleep?

My brother is a lawyer. He told me last night (all the time, actually) he can't stand being a lawyer. All they do is stab each other in the back and argue. What kind of job is that?

Time has value. Why this scum bag is dragging me down, and himself down and now lawyers are in on this ... all because he doesn't know how to pay some damn bills! It's unbelievable.

You have 5 lawyers in your family?
Why havn't they helped you and get this matter closed?

Has it been worth it?
You have invested a lot of time and energy into this, you should sue because of it

I am not taking sides on this issue but what you said above and if 'Mr. X' should read this, isn't it possible for him to use this against you?

I think it is best to keep all of this private until after any/if any litigation is complete. And even then I think you should wait a bit before saying anything, if at all. If 'Mr. X' is what you alleged him to be then would he not want to read your post/thread here and use that against you?

What really amazes me is that people will openly discuss legal issues in an open forum such as this. I would think that the lawyers (if any) in your family would advise you not to do this.

Just something to seriously think about.

I doubt that since nobody knows who "Mr. X" is.

Now.... early on in this saga some folks here gave Mr. BlackBird advice on how to muddy up the guy's name on the web (to which I advised against).

Did you do this BlackBird? Really not too smart if you did.

And I'm *still* trying to figure out why you went back for a second and third beating with this idiot. (A good attorney will ask you that as well).

OK, I'll answer some questions to clear some things up ---

4 of the lawyers in my family are out of state, so they can not assist me in this matter. The one who lives here could handle this, but she isn't the type I want to bug about this. It's better to hire someone who can come aboard with experience and fresh energy. Of course, if this goes to court, i will bring my cousin on board since she will do all the legal work for FREE. Smile

Since I have NEVER mentioned Mr. X's name to any one at any time, there is nothing he can use against me. I could be talking about anyone, anywhere. Sure, he could show this to his lawyer if he is reading this, but how would one prove that I am talking about him? And even if it did, how could he prove that this harms his business, since no one but he and I (and our lawyers) know I am talking about him?

No, I have not created a website such as www.thisguy's siteSUCKS.com or whatever. Even though I am allowed to do that --- as long as the TRUTH is there, and not lies --- it just has not been an option I have considered.

I simply want to get paid.

And that's why I hired a lawyer. Let him deal with this while I work. It takes me bout 5 minutes to share this with you, and I feel it is importnt if it helps anyone else from dealing with such a bozo in their future.

As for why I dealt with this guy enough to drum up $4,000 in invoices, remember, once he asked me to do some gigs, he asked me to do a lot at once. Then I sent him invoices. Supposedly this is a business where WE don't get paid until the COURT REPORTERS or VIDEO PRODUCTION companies get paid by the lawyers. So I did not think twice about taking additional gigs since I figured a few weeks or a month or so would go by before getting paid.

It's when I suspected something fishy that I said something to him and he started acting weird. And then the first invoice came in all marked up.

So once again, I HAVE NOT MENTIONED THIS GUY'S NAME TO ANYONE. There is no slander or libel or tortious interference. The most I did is call one court reporter and asked how long a certain deposition was and to please forward a copy of their bill to me so I cna prove how long it was.

After all, perhaps he was confused and thought that the deposition really was one hour ----- DESPITE THE FACT that there were 9 lawyers in the room and it took them 45 minutes just to settle in and unpack their briefcases!!!! Geez ..... what a jerk that guy is.

I did NOT tell them "Hey, don't work with this guy anymore." I did not do anything to harm his name or his business. Good luck to him trying to drag me into court and try to prove this. Once he does, I can easily counter sue him and then recover my legal costs --- and more.

Geez, isn't this all so ugly? All because of one man's greed?

What cracks me up is that now he wants me to sign something saying I want disparage his name and THEN he will pay me. Uh ...... he owes me money. Any judge would agree with that. Why in the world should I have to sign something to get paid?

I would extend credit much more cautiously. After he had not paid for the first $1000 (or less) of your work, I would have shut him down and say no more work till you pay. Why extend yourelf so far? But that's water over the dam now.

Do you have any recourse through Small Claims Court? If what X owes you exceeds the court limit, then split what X owes you into separate claims.

That is not legal to do in most situations. There are statutes that state that all issues pertaining to matter must be dealt with in the same suit. Otherwise I could harrass you with a $10 a week claims forever.
