Who owns the clips? Can't Post

A couple of questions back, a gentleman asked "who owns the footage"?

Your response was, I believe, correct about the client owning the footage. That said, the question comes up quite a bit, especially as regards photographers who sell copies and retain the original shot.

A little more clarification might be in order. I seem to remember in my course (which paid for itself more times than I can count) that you provided release forms that would actually allow fairly unrestriced use by the videographer for most purposes.

Who owns the clips? It depends on what's in your contract!

No contract? Shame on you.

A couple of highlights:

- Work created by an employee belongs to the employer
- Work created by an independent contractor belongs to the contractor, not the client (unless the contract specifies a "work made for hire").
- People own the rights to their own likeness and voice. To use those images in your work, you need a release from the person UNLESS the images were taken in a venue where there was "no reasonable expectation of privacy".

There are lots of other twists, turns, and extenuating circumstances surrounding the whole question of intellectual property. That's why there are lawyers who specialize in it. But for a start, go read the article in the Free Library on copyright by Douglas Spotted Eagle.
