what does this mean? Can't Post

Hey all, I'm currently writing up a contract for a video release (a form that gives us permission to use someone else's work in our own). I'm taking parts from an already built template I'm modifying, however I have a question regarding one of the clauses and wondered if anyone here knew the definition of it. In this, the person giving us the footage is the Licensor, and we are the Licensee.

Licensor acknowledges that, under the Federal Communications Act, it is a Federal offense to give or agree to give anything of value to promote any product, service or venture in the Picture, and Licensor warrants and represents that Licensor has not and will not do so.

Is this saying that our company cannot charge clients to put material in our production? (in this case a tv show). How does this differ from product placement?

To me, all of that mumbo-jumbo is just saying that you can not advertise within the picture (advertising is the promoting of a product for compensation).

I could be wrong, but that is what is sounds like to me.

It does sound like that, but that makes me wonder about product placement. That's all advertising, and while this particular contract template may not allow it, it seems to refer to a particular guidline from the FCC. I may just remove it if it's a conditional thing. Just wondered if anyone knew what it meant?
